Welcome to The Bundle Apothecary! The terms “we”, “us” and “our” refer to The Bundle Apothecary. The Bundle Apothecary operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). The Bundle Apothecary is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (these “Terms”) describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy $https://thebundleapothecary.com/policies/privacy-policy$. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, you may be asked to provide certain information (e.g., email address, billing, payment, and shipping information). You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 – OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services. However, colors or product appearance may differ due to device and display settings. We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or match depictions exactly. All descriptions of products are subject to change at any time without notice, and we may discontinue any product at any time or limit quantities on a case-by-case basis.

Bundles & Variations. Our bundles are curated; contents and colors may vary from photos. Unless a listing guarantees a specific item, photos are illustrative. We may substitute items of equal or higher value based on availability to ensure timely fulfillment. We make reasonable efforts to honor color/theme preferences (including “kid vs. adult” selections when offered), but exact shades or items cannot be guaranteed.

Safety Notice. Many items may include small parts. Not for children under 3. Adult supervision recommended.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Your order is accepted when we confirm acceptance and successfully process your payment. Please review your order carefully before submitting; change or cancellation requests may not be possible once accepted.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy. For bundles, partial returns of individual items are not accepted; bundles must be returned complete and unused per the Refund Policy.

Substitutions. We may substitute items of equal or higher value to ship your order on time.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and shown in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Promotions. Unless otherwise stated, promotions cannot be combined, are one code per order, and are while supplies last.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You represent and warrant that (i) the payment information you provide is true and complete, (ii) you are authorized to use such payment method, (iii) charges will be honored by your payment provider, and (iv) you will pay all charges including shipping/handling and applicable taxes.

SECTION 5 – SHIPPING AND DELIVERY

Damage/Shortage/Wrong Item. Please inspect upon delivery and contact hello@thebundleapothecary.com  within 7 days of delivery with your order number and clear photos. We will work to remedy the situation—e.g., replacement of affected items, reshipment of missing items, or refund/credit, as appropriate.

Incorrect/Insufficient Address. If a package is returned due to address issues provided at checkout, we can reship to a corrected address; additional postage may apply.

SECTION 6 – INTELLECTUAL PROPERTY

All names, logos, product and service names, designs, and content on the Services are owned by The Bundle Apothecary, its affiliates or licensors and protected by applicable laws. These Terms permit personal, non-commercial use only. No reproduction, distribution, modification, display, performance, or derivative works without our prior written consent. All rights not expressly granted are reserved.

SECTION 6A – GIFTS, NOTES & AGE APPROPRIATENESS

Gift Notes. We will print gift notes as provided but may decline or edit content that is unlawful or inappropriate.
Kid vs. Adult Themes. Some bundles include mature themes intended for adults. Where we offer a “kid vs. adult” selection and you choose “kid,” we will avoid adult-themed content. If no selection is made, we will curate at our discretion.
Small Parts. Many items include small parts; not for children under 3.

SECTION 7 – OPTIONAL TOOLS

You may be provided with access to tools offered by third parties “as is” and “as available,” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain materials or links to third-party websites. We are not responsible for examining or evaluating third-party content or sites and are not liable for your use of them. Review their policies before engaging in any transaction.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

The Bundle Apothecary is powered by Shopify, which enables us to provide the Services. However, all sales are made directly with The Bundle Apothecary. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and The Bundle Apothecary, and you expressly release Shopify and its affiliates from all claims related to your purchases and transactions with The Bundle Apothecary.

SECTION 10 – PRIVACY POLICY

Because the Services are hosted by Shopify, Shopify collects and processes certain information to operate and improve the Services. SECTION 11 – FEEDBACK

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose. You represent and warrant that you own or have rights to the Feedback and that it complies with these Terms.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

From time to time there may be information on the Services containing typographical errors or inaccuracies (e.g., pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, change or update information or cancel orders if any information is inaccurate at any time without prior notice.

SECTION 13 – PROHIBITED USES

You may use the Services for lawful purposes only. You agree not to, among other things, violate laws; infringe intellectual property; harass or harm others; transmit malware; scrape, spam or circumvent security; or engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Services. We may suspend or terminate access for violations.

SECTION 14 – TERMINATION

We may terminate this agreement or your access to the Services at any time in our sole discretion without notice; you remain liable for amounts due through the date of termination. Sections intended to survive will do so, including Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, Privacy Policy, and similar provisions.

SECTION 15 – DISCLAIMER OF WARRANTIES

Except as expressly stated by The Bundle Apothecary, the Services and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers; portions may not apply to you.

SECTION 15A – FORCE MAJEURE

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor issues, supply shortages, carrier delays, government actions, or other force majeure events.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no case shall The Bundle Apothecary or its affiliates, partners, officers, employees, agents, contractors, service providers or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, revenue, savings, data, or replacement costs, arising from or related to your use of the Services or products.

Liability Cap. To the fullest extent permitted by law, our total liability for any claim relating to the Services or products shall not exceed the amount you paid for the order giving rise to the claim.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless The Bundle Apothecary, Shopify, and our respective affiliates and personnel from any losses, damages, liabilities or claims (including reasonable attorneys’ fees) arising out of (1) your breach of these Terms, (2) your violation of law or third-party rights, or (3) your access to or use of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, the remainder will remain in full force, and the unenforceable portion will be deemed severed to the extent permitted by law.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right is not a waiver. These Terms and any policies posted on the Services constitute the entire agreement between you and us and supersede prior agreements regarding the Services.

SECTION 20 – ASSIGNMENT

You may not delegate, transfer or assign these Terms or your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without notice.

SECTION 21 – PUBLICITY CONSENT (OPTIONAL)

From time to time, we create short-form videos and posts showing how we curate bundles. If you opt in, you grant The Bundle Apothecary a non-exclusive, worldwide, royalty-free license to use and display your first name (or nickname you provide) in connection with such content across our websites, emails, and official social channels (including TikTok, Instagram, YouTube, Facebook, and Pinterest) for marketing and promotional purposes.

Voluntary: Consent is not required to purchase.

Limited scope: We will only use your first name (or nickname), not your last name, address, or payment data.

No endorsement/compensation: Your consent does not create an endorsement obligation and does not entitle you to compensation.

Withdrawal: You may withdraw at any time by emailing hello@thebundleapothecary.com  with your order number and subject “Withdraw Social Consent.” Withdrawal will apply to future content and does not require us to remove previously published content, though we will make reasonable efforts to edit or remove where feasible.

Minors: If the order is placed for a minor, only a parent/guardian may provide or withdraw consent.

SECTION 22 – GOVERNING LAW; VENUE (VIRGINIA)

These Terms and any separate agreements whereby we provide you Services are governed by the laws of the Commonwealth of Virginia, without regard to conflict of laws principles. You and The Bundle Apothecary consent to exclusive venue and personal jurisdiction in the state courts located in Loudoun County, Virginia and the federal courts sitting in the Eastern District of Virginia.

Headings are for convenience only and do not affect interpretation.

SECTION 24 – CHANGES TO TERMS OF SERVICE

We may update these Terms at any time by posting changes to this page. We will notify you of any material changes as required by law. Your continued use of the Services after changes become effective constitutes acceptance of those changes.
